Art. 406.8(B)(2)(b)

I installed the Hidged WP Cover outside as to the condition of the above reference article. When this cover is closed it is approved for wet locations. It is used as an attended outlet. Still it is considered a VIOLATION. Why?

406.8(B)(2)(a) is the correct section for 125 & 250v 15 and 20 amp receptacles, 406.8(B)(2)(b) is for Other Receptacles that would not fall under those specifics, ie 30 or 50 amp receps for example.

That's a question you should ask your inspector, tactfully, and you should whenever there is a conflict.

The deciding factor is whether the location is considered damp or wet. Check the NEC definitions.

Without looking (because, let's face it, that would spoil the surprise), I believe whether a receptacle is "attended while in use" is no longer present, in the 2005 code.

But the '05's in the truck, and it definutely burns less calories to throw that up and let it get shot down. :D

The while is use is gone in section 406.8 B 1 NEC. A standard WP cover is marked WP with cover closed, so its ok to install as long as you don't open the cover. The 2005 NEC removed the words "outdoors" and any wet location requires a WPIU cover.
While "in use" remains for other receptacles, the rule above is for the 15-20A 125, 250 V ones.
Stock up on bubble covers.
In Washington State, a wet location requires a GFCI for any occupancy.
