No just as long as it is not on the supply of unit
It can be on the supply, provided it is in compliance with all other pertinent sections, and not on the load side of the equipment disconnecting means. In other words, the HVAC equipment must be capable of being de-energized without de-energizing the receptacle.

Also, one- and two-family dwelling evaporative coolers are excepted.
