Article 680.40 Spa & Hot Tubs

I have a question reguarding a permanently installed manufactured hot tub. I do a lot of work with in ground pools and am quite fimilliar with this section of the code. I recently installed the wiring for this tub using 6-3 non metallic sheathed cable as allowed by art 680.42 part C. After the disconnect switch I used a combination of PVC conduit and non metallic flexible conduit. I was told by the AHJ that the installation of non metallic sheathed cable does not comply because of the under water light. The light is part of the tub from the manufacturer and operates on a low voltage 12 volt transformer. I have also read the requirements of art# 680.22 & 680.33 Who is correct here? Thanks for your help!

680.23 (F) (2) Equipment grounding. Shall be connected to an insulated copper equipment grounding conductor installed with the circuit conductors.
Your equipment ground has to be insulated.

I'm sure the manufacturer of the spa wired the pool light as required per their product standard and the NEC installation standard. (the EGC to the light is insulated) The portion of the wiring you are installing has nothing to do with 680.23 or 680.33.

Thanks for your input.I feel that the insulated equipment grounding conductor requirement is aimed at the wiring between the power source and light fixture,not the incoming feed. Also could someone please tell me why there is a requirment for the insulated ground in other applications, such as pools, etc. Why is a good solid bare ground connection not just as safe? Inspectors seem to love to inforce this code but no one seems quite sure why this code is in place !!!!
