ATS panel

I have a situation where a residential ATS panel has been added to an existing service. It has been fed correctly from the service with a 70amp breaker thru carflex with appropriate neutral and ground. The circuits to be fed from the ATS panel were taken off the breakers in the original service, wirenutted and extended into the ATS panel thru the same carflex without neutrals (or grounds). Under the '05 NEC, what section covers this situation?

300.3 Conductors.
(B) Conductors of the Same Circuit.

All conductors of the same circuit and, where used, the grounded conductor and all equipment grounding conductors and bonding conductors shall be contained within the same raceway, auxiliary gutter, cable tray, cablebus assembly, trench, cable, or cord, unless otherwise permitted in accordance with 300.3(B)(1) through (B)(4).
