I am trying to understand what it is you are asking?

A wireway connected to an ATS is not part of the ATS but is part of the complete feeder.

This stems from this question...

Can emergency feed to the ats and the load be in the same enclosure (besides the ats)? The load is a life safety load. If they can only be together in the ats and must be separated everywhere else, if the gutter (which is mounted aprox 8 inches above the ats and is connected to the ats via nipples) contains the emergency feed en route to the ats and the load from the ats that leaves the gutter in a separate pipe. Are the rules for the gutter ,since it is connected to the ats as a wireway, the same as the ats? Can the load and emergency feed of the ats be together in the gutter? The room that they are in is sprinkled and fire rated.

So you are asking if the line feeding the emergency ATS and the emergency feeder coming off the load side of the ATS can be in the same wireway? IMHO they can as the supply to the ATS is part of the emergency system. This is not the same as having service and non-service conductors in the same raceway.

I agree that 700.10(B) prohibits emergency and non-emergency circuits from being contained in the same raceway. But I am not sure that is what we have in the OPers case.

If the question is asking whether a wireway is considered a wireway or if it becomes part of the ATS enclosure the answer is, it's a wireway, it is not part of the ATS and since the OP says it's "Life Safety" it seems as though it is pertaining to a healthcare facility meaning the 517.30(C)(1) is the applicable section.

(1) Separation from Other Circuits. The life safety branch and critical branch of the emergency system shall be kept entirely independent of all other wiring and equipment and shall not enter the same raceways, boxes, or cabinets with each other or other wiring.
Wiring of the life safety branch and the critical branch shall be permitted to occupy the same raceways, boxes, or cabinets of other circuits not part of the branch where such wiring complies with one of the following:

(1) Is in transfer equipment enclosures

(2) Is in exit or emergency luminaires supplied from two sources

(3) Is in a common junction box attached to exit or emergency luminaires supplied from two sources

(4) Is for two or more emergency circuits supplied from the same branch

The wiring of the equipment system shall be permitted to occupy the same raceways, boxes, or cabinets of other circuits that are not part of the emergency system.

Thanks for all the input. A contractor has done some work recentlyand we are just trying to determine if their interpretation of the code or ours is correct. Concensus is saying that we are correct in the fact that they need to re-route some wiring!! Thanks to all.
