I have a resi. service on a pedestal with a meter socket only.
A generator was installed and the EC came into a non service rated ATS from the meter and then out to the now sub panel.
Am I right for flagging it for the ATS being non service rated?

If the Auto Ttransfer Switch is outside the building it may or maynot be required to be service rated. We had one non-service 480 VAC rated. Xfer switch not listed with a Motor Control Center that we replaced with NEMA 3R enclosure outside the Control building. Since it was not service rated and it was in State of NE, during a utility gas compressor station upgrade and a new building with a separate switchyard service 35KV utility addition buckets in that spare lineup in a switchyard building then downstream was the provisions for the 480V motor control and the Hyundai Heavy Industry Perfect Harmony Variable Frequency Drive and compressor PLC and 480 V additions.
 
Since the OP mentioned residential service and meter sockets I think it's fair to assume 230.82 applies and it does not list a non-service rated ATS as being allowed before the service disconnect

Electrical service requirements for customer supplied generators may not meet the interconnection process resulting in parallel neutral conductors. Allowance may or may not meet AHJ install conformance since electrical contactor or private owner is not a service provider the premesis wiring may be considered a feeder not service entrance . It might depend on electrical utility service entrance requirement committee (EUSERC) rules for adoption and tariff rules for electrical service dependent on the meter agreement with State requirements to specify conductor added short circuit amps rating of disconnect and isolation of neutrals.
Therefore utility service conductors and self provided equipment have different rule set of conductors.

Yes. This is an NEC violation as it must be SUSE rated and also violates the listing of the switch. ATS used for optional standby would be covered under UL WPTZ. A non service rated rated ATS must have specific OCP ahead of it. See here: http://productspec.ul.com/document.php?id=WPTZ.GuideInfo
