Automatic transfer switch feeding one of two main disconnects

A single-family dwelling residential solar install that can run in parallel or isolated mode. The utility meter feeds two main disconnect panels outside with separate feeds. One panel feeds most of the house and the other feeds an instant water heater and a few other loads in the house. The transfer switch is between the meter and the biggest panel.

1) The large loads have load management devices but there are still 17 other 15/20/30 amp breakers being fed by the automatic transfer switch from the back-fed 40 amp breaker. So the transferred loads are too much in an automatic transfer scheme. Shouldn't the breaker be tied down also?

2) There is no disconnect labeling/location info on the two main service panels or solar disconnect. Is it also a problem that part of the house can be fed with the generator and part fed by the utility?

3) The load management wires (along with some other existing wires were brought into knockouts with no connectors.

4) No SPDs installed

Anything else I should be wary of?

So for:
1) 702.4(B)((2). 408.36(D)

2) 702.7(A). Since it can also parallel, 705.10. With the utility and generator both supplying the building wouldn't we have an issue with 225.30 or 230.2?

3) 312.5(C)

4) 230.67

Any opinions?
