I am allegedly about to be awarded a contract for a mens wearhouse. the company that is awarding the contract is "inline construction" I beleive out of vegas. anyone wiried one of the stores lately. not being an attorney and I guess I will get one's opinion but who is ultimately responsible to me for my money. it is really just a bunch of lights this will be my first out of state contract.

Jonesjax, the first thing I do with an out of state contractor is to make sure who I'm dealing with. I don't want to just see a business card with a phone number. I make sure there is a real business and the real location of said business. Whatever state they are located in you can check thier corporate records. See when they were incorporated and if they are an active corporation. You wouldn't believe how many contractors operate as corporation that was disolved years ago.

Look for a Blue book listing and check their home town phone directory. Make sure that all the addresses match.

Get as much money as you can up front and on the first draw. Leave very little for the final payment. Make sure that you are paid in full before signing any lean waivers.( some companies will try to hold 10% for the first few months to make sure you honor your warranty ) No Deal, Money Now!

What were the terms of your contract? If your accepting their terms. the best advice is, get a part time job now so you can afford to pay for their job.

I had problems once with an out of State GC. I was able to find out the phone number and person in charge for the business the GC was working for. My final payment was 60-days old. I called the owner's rep, discussed it with them (that was a Monday), Tuesday I had a Fed Ex package with my final check.

My advice to you is to try to find out who the GC answers to. Also, leins work well in getting attention. I've never had to actually file a lein, just the threat can make an impression.

Most business owners are aware that some GC's play with the money, and they will do everything they can to make sure the subs get paid. Whatever you do, don't let you lein filing time expire!
