I guess you mean you don't need wet location over a tub.

Actually you don't need wet location trims if the can is more than 8' over the threshold of the shower area. Take note of the last sentence. All cans I have used are rated for damp location.

410.10(D) Bathtub and Shower Areas. No parts of cord-connected luminaires, chain-, cable-, or cord-suspended luminaires, lighting track, pendants, or ceiling-suspended (paddle) fans shall be located within a zone measured 900 mm (3 ft) horizontally and 2.5 m (8 ft) vertically from the top of the bathtub rim or shower stall threshold. This zone is all encompassing and includes the space directly over the tub or shower stall. Luminaires located within the actual outside dimension of the bathtub or shower to a height of 2.5 m (8 ft) vertically from the top of the bathtub rim or shower threshold shall be marked for damp locations, or marked for wet locations where subject to shower spray.

So the way I'm reading 410.10(D) Where they are subject to shower spray they must be listed for wet locations. So if I see that the shower head is going to be either ceiling mounted or a hand bar I do require a wet listing. For a standard shower head set up where the head is pointing down I would not. I realize that a hand bar can always be installed later but its only as good as when I'm inspecting it.

I, as well as most electricians around here, install shower trims over a shower even if the ceiling is 9 feet high. I have been asked why I put standard cans with open trims over a hydromassage tub- no shower. I simply state because I can and they give a nicer light.
