As per Article 410.4(D) - If not subject to shower spray it needs to be listed for damp location & if subject to shower spray it would need to be listed for wet location.

Unless it's more than 3' from the edge of the tub.
 
I know that 410.4(D) covers pendant type fixtures hanging over the tub, but does this also include a wall mounted sconse. This hydro-massage tub does not have a shower. This customer is bound and determined to put a couple of these fixtures at the edge of the tub for a better lighting effect. The fixtures they picked out are not "damp location". Is there any decent looking damp location fixtures out there? Thanks for the replys.
 
Well the inspector I was dealing with agreed that since my fixture was 8'8" over the tub it was not in the tub zone and allowed a regular light so you might check with AHJ to see what they will allow.

Edit; if it is a wall mount sconce light you might have to keep it 3' horizotal or above 8' above the top of the tub.

(A) Wet and Damp Locations Luminaires (fixtures) installed in wet or damp locations shall be installed so that water cannot enter or accumulate in wiring compartments, lampholders, or other electrical parts. All luminaires (fixtures) installed in wet locations shall be marked, ``Suitable for Wet Locations.'' All luminaires (fixtures) installed in damp locations shall be marked, ``Suitable for Wet Locations'' or ``Suitable for Damp Locations.''

(D) Bathtub and Shower Areas No parts of cord-connected luminaires (fixtures), chain-, cable-, or cord-suspended-luminaires (fixtures), lighting track, pendants, or ceilingsuspended (paddle) fans shall be located within a zone measured 900 mm (3 ft) horizontally and 2.5 m (8 ft) vertically from the top of the bathtub rim or shower stall threshold. This zone is all encompassing and includes the zone directly over the tub or shower stall. Luminaires (lighting fixtures) located in this zone shall be listed for damp locations, or listed for wet locations where subject to shower spray.


A revision of 410.4(D) clarifies that securely fastened luminaires installed in or on the ceiling or wall are permitted to be located in the bathtub or shower area. Where they are subject to shower spray, the luminaires must be listed for a wet location.

Luminaires installed in the tub or shower zone and not subject to shower spray are required to be listed for use in a damp location. GFCI protection is required only where specified in the installation instructions for the luminaire.

The intent of 410.4(D) is to keep cord-connected, chain-hanging, or pendant luminaires and suspended fans out of the reach of an individual standing on a bathtub rim. The list of prohibited items recognizes that the same risk of electric shock is present for each one.
Exhibit 410.1 illustrates the restricted zone in which the specified luminaires, lighting track, and paddle fans are prohibited. This requirement applies to hydromassage bathtubs, as defined in 680.2, as well as other bathtub types and shower areas. See 680.43 for installation requirements for spas and hot tubs (as defined in 680.2) installed indoors.

If the sconces are not listed for Damp Locations within this space they are not allowed.
