Bonding of Mesh Pool Fence Poles within 5'

an issue came up where the poles are being installed in a couple of areas that are 3' away from the water's edge. They claim that the fence is isolated from the ground by a special cup and hinge. The cup and hinge are placed into the ground first then the stainless steel pin is inserted into the cup, then the rest of the fence pipe is inserted onto the stainless steel pin. By installing it in this method they have created a barrier from the ground to any of the metal parts involved in the fence. My question is does this really work to meet code? Should this be bonded if its within 5'?

There is no exception in 680.26(B)(7) for metallic parts that are isolated from earth.
(7) Fixed Metal Parts. All fixed metal parts shall be bonded including, but not limited to, metal-sheathed cables and raceways, metal piping, metal awnings, metal fences, and metal door and window frames.
