Breaker size for a 208/1/40a appliance

seems like a silly question/topic, but it's being questioned. Cutsheet says load is exactly 40 amps. 8,320 watts. It's a coffee brewer. Some say use a 50/2. Some say 40/2. Plug is a 14-50.
I'm thinking a 50/2 feels safer - maybe I'm being an overconservative EE -

Why wouldn't you use a 50/2 breaker along with conductors suitably protected by a 50A breaker?

If you could talk yourself into using a 40A circuit, you could use 8AWG NM. If NM is allowed in the occupancy.

But if you agree that a 50A circuit is a better choice, you could use 8AWG MC. Or 8 AWG THHN in conduit.

IMHO there is no good reason to use a 40A circuit here.

I agree as long as it's not NM cable you still need #8's so why not use a 50 amp OCPD.

commercial kitchen - it will be either MC or EMT/wire - yeah a 50/2 makes sense
