5 over 2 only works if the first floors are type 1 or 2 construction with a fire rated ceiling or floor of the residential 4 or 5

You can't use Romex in the retail part if it's Type II Construction. It usually tells you on the first or second page of the Architectural drawings what construction type it is. You're jumping into Pandora's box if you want to determine for yourself what construction type it needs to be. I don't recommend it.
