Bus Duct and 110.26(E)

I have a situation where bus duct was installed vertically leaving a switchboard with a 90? section and traveling over the front of the switchboard. The SB is about 5' high and the underside of the bus duct is 6'2". Seems like the required 6'6" has to be met once the bus duct extends beyond 6" past the front face of the switchboard. Any opinions?
 
The height used to be lower, but I think it was 6'3". Otherwise, by recent Codes you are correct.

I'm curious....does the ceiling height/structural members prevent the horizontal transition from being installed any higher?

I know this is a technical violation, but if the ceiling height or some other obstruction prevented the bus duct from being installed any higher by boss [AHJ] would allow this installation.
