Bus Duct Clearance

There is an existing 2500A, 277/480V bus duct and the space from the front of the bus duct(where the access plates are) to existing riser conduits is 32". There are existing 200A bus duct switches on each floor installed at the time of the original construction..1970s. Because there is only 32" between the bus duct and conduits does this mean I am prohibited from ever installing a new bus duct switch because I would never have my required clearances or would I be covered if I have signage on the switch that states the bus duct switch should not be worked on while energized?
 
How would the working clearance be met for a bus plug located 20' up in the air?? My guess is that a bus plug up in the air would not be considered to require inspection or servicing while energized. would it be any different for one that can be reached from the floor? I'm not sure....
 
would it be worth to review this situation with an inspector and receive a variance? Even with a variance would the PE still be responsible if something happend in the future to someone working on that disconnect and the proper clearance were not there?
