Bus overloading question.

A coworker and I have been discussing a job we have with some of our installers and an electrician and it seems everyone has different opinions on this job.

So we have a 200A service with 2 breaker spots. Each one is a service disconnect. One is rated for 200A and feeds the subpanel in the basement where all of the breakers are. The other disco is a 50A that is likely tied to an A/C unit. The label on the panel states that each breaker has it's own bus and that the main slot can handle 200A max, and the other can handle 35-50A. Our install crew wants to install a 100A subpanel that will be fed by the 50A breaker and land the 40A of solar in this new subpanel and relocate the A/C breaker here as well. Their reasoning is that since the A/C is the only load in the panel, it is impossible to overload the 50A rating of the breaker feeding this sub and the solar will either supplement the A/C or backfeed and there is no chance of overloading the 50A max.

Coworker, says that we can't do this because the 50A rating of the bus only allows for 10A of solar because of the 120% rule so installing a 100A sub and landing 40A of solar in this sub (which is protected by a 50A breaker in the MSP) is violating this rule.

We're trying to avoid doing a service upgrade and also trying to avoid messing with the 200A sub to save costs. What would you guys recommend?

'Coworker' is wrong. The bus is on the line side of the service disconnecting means and therefore the 120% rule does not apply to it. Install crew has it right.

As long as you do not try to put a greater than 50A breaker on that bussing then there is no way it can see greater than 50A operating current it is rated for. There is nothing on the utility side protecting it from a greater current regardless of whether you install solar or not.
