C53 Contractor Pull Permits for swimming pool Electrical Panel repair or replacement?

Can a C53 swimming pool contractor pull a electrical permit for swimming pool Electrical Panel repair or replacement? If so, does the technician working on the job need to be licensed or certified if he's works alone?

This question can not me answered easily by my local AHJ or the California Contractors Board.

I am involved in a situation where the swimming pool contractor is talking smack about our electrical work. A transformer in a swimming pool panel smoked on original installation and the swimming pool tech is claiming it was wired wrong. Kinda of insulting since its only a white and black wire.

I want to move on but the CSLB called me since the customer filed a complaint. My 1st since 2002.

If the swimming pool contractor (or his employee is not a certified electrician) is not authorized to install electrical sub panels after the pool was built then the CSLB is not interested in following through with the complaint. CSLB is investigating and going to get back to me to see if C53 can do this sort of work -
Just thought I would ask if anyone knows details

To my knowledge only C10 contractors are required to use certified electricians. I know that as a C46 we're allowed to do electrical work related to solar without using certified electricians. Don't know off the top of my head if the same applies to a C53, depends how the law is written on what they can do. The law is not too detailed on this.
 
Btw, I'm curious that the CSLB 'can't easily answer this question'. Did you ask them and is that what they told you?


YES - the Lydia from the CSLB called me about the complaint and I explained the entire situation. She told me that as a C-10 contractor I was not required to hire certified electricians - so I know she is not up on her laws. I explained to her that we (C-10) are required to hire certified electricians to do any wiring work. I asked her If the C53 swimming pool contractor was allowed to do the same electrical work and she did not know the answer. I also asked her if the swimming pool contractor needs to use a certified electrician and she did not know that answer. So she forwarded my case to the investigation team... I will update when I find out more. In the meantime if anyone has any expert knowledge on this subject it would be appreciated. I really try to know more than the average bear - so I really want to know the real answer.

The requirement that C-10s use certified electricians falls under the purview of the Department of Industrial Relations, not the CSLB. So I'm not surprised that someone from the CSLB wouldn't be up to speed on that. To my knowledge it does not apply to any contractor classifications other than C-10. In your description of the conversation, you don't mention whether you asked if the C-53 is allowed to do electrical work that is incidental to his trade. That would be an appropriate question for the CSLB.

The pool contractor C53 certainly can install the pool panel under his license and permit under the supplementary work. I would think he can also repair what he installed.

Replacing a electrical panel not part of building a pool he could have problem with working outside his classification.

Word of advice. Don't trust the CSLB investigator. Get things in writing. Get their email , be polite. Let them know that you are always " ready , willing and Able" to complete , repair any work under your contract.
Always keep the CSLB satisfied.

CSLB views the customer is always right.

Regardless if a c56 uses certified electricians, replacing electrical panel alone is outside his cope unless tied to a pool contract.
