Can "TC-ER" cable be used like NM cable?

The other day I came across a split system air conditioner in a single family residence where the installer had used type TC-ER PVC jacketed cable to power it. The TC-ER was run through the walls like NM. I said no based on its listing. It was direct burial rated and had no green or bare conductor also. Is there an application where this is allowed?

No, it can?t be used as NM ? it should be; it?s far superior, but it isn?t. IMO the prohibition is strictly the manufacturer's influence on the CMP.

It bothers me that you report it doesn?t have an integral EGC ? that?s one of the requirements to be marked ?-ER? or at least functionally used for the purpose. See Section 336.10(7). Otherwise it can only be used in a raceway, tray or on messenger cable. [336.12(2)]
