I am running power to a subpanel in a detached garage and wanted to come off of the backside of a fused disconnect on the exterior of the home. The feeders come from the meter to the fused disconnect and then proceed to the main panel inside the home. Code article 240.21 b (4 and 5) Appear to be the correct code articles but I do not see anything regulating the point of the tap. Any advice would be appreciated. ?

you can make the tap wherever you want. what you cannot do is make connections to terminals that are not appropriate such as two wires on a terminal listed for only one conductor. You do of course have to follow the various applicable tap rules.

It sounds like you are talking about the service disconnect. If that's the case then the rules are totally different for tapping on the line side vs. the load side of the disconnect.

240.21(B) would be the correct section for tapping on the load side of the fuses, and is what I would recommend to you.
