CB slash rated or straight?

I had a discussion with co-worker about slash and straight rated CB on a Delta service with high leg. He believes you can use a slash rated CB and I objected and argued it needs to be straight rated because of B phase being 208 volts to ground. Is there a code section that dictates this? Thanks.

You can use slash rated breakers in a panel that has a high leg, they just can't connect to the high leg.
