Chapter 1-3 applied to control wiring

Good morning

on my job a separate hvac contractor installed control class 2 wiring in chapter 3 wiring methods in a sloppy way.
HVAC contractor used non metallic sealtight which is not allowed in nyc.
We are still in 2008 nec with local amendments .

I got violations for hvac contractors work

250.4 non metallic connector used at CU
300.10 no continuity from LB to splice box, sealtight connector loose at LB
314.15 Roof LB not rated for wet location (no gasket)

I understand the violation should go to the owner but my question is
Is the inspector correct for applying rules from chapter 1-3 to control wiring ?

Chapter 7 scope supplements or modifies Chapter 1-4. So raceway requirements in Chapter 3 would apply unless clearly supplemented or are modified in Article 725.

Maybe he got the needed permission to install it?

Section 356.10 - Revise the heading and the first sentence to read as follows:
356.10 Uses Permitted by Special Permission Only. The use of LFNC shall be permitted by special permission only, as follows:

I see. Thank you . The inspector is correct .

I should not be receiving a violation for another contractors work.
What should be defense?
A call to inspectors supervisor, written statement from property owner I did not do the low voltage part of work ?
