I have a new baptistry being installed and am looking for a code reference.would this be classified as a spa? It has a control box for recirculating pump and heater but will be drained untill needed.

I would classify it as an indoor pool.

Definitely a pool,

Pool. Manufactured or field-constructed equipment designed to contain water on a permanent or semipermanent basis and used for swimming, wading, immersion , or therapeutic purposes.

The term Immersion was added to the 2008 NEC to address this type of situation.
