Is it an NEC violation to use a 3 pole Circuit Breaker for a two pole application, as long as the amperage is correct?

I would defer to manufacturers installation/ ul listings.
This would determine NEC compliance.
UL Listed breakers have been fully tested for all combinations of poles.
