circuit conductors in 2 separate multiconductor cables.

Contractor is feeding a panel with 2 multiconductor cables. In the one cable they have the 3 phase conductors and the ground and in the second cable they are using 1 cable for the neutral or grounded conductor and not using any of the other cables. How I read 300.3(B) is that all circuit conductors have to be in the same cable. Has anyone ever installed cable this way? They are not parallel conductors.
