Code for Cable Tray

I am new to the NEC code, which will be obvious as you read on...
A recent job was speced to have ss tubing laying in the cable tray next to the wire.
The electricians said it was an NEC code violation.

I have two questions:
Can cable tray be used to hang light plumbing such as 3/4" .035 stainless tubing.
More importantly for me, can this tubing be in the cable tray?


The code table 392.3A says ridged conduit is ok. I realize that ss tubing is not EMT.

I assume that the codes are not to be interpreted and what they say is allowable is just that. How flexable is the code?
 
Code is permissive. If they don't say you can't do it, generally, you can. But unfortunately, in this case, it says you can't do it:

As far as hanging things from the cable tray, see 392.6(J) and check manufacturers instructions.
