Is there any code violation with the gutter wireway location in the attached photograph? Can this be installed on the floor?

Any requirement that the top is secured or can it be loose?

I don't see any reason it cannot be on the floor.

I am pretty sure the code requires the covers be secured.

You have a trip hazard which would be an OSHA problem but not a NEC problem.

I would be concerned about trip hazards and ADA access since this is a public place.
There are liability concerns if someone trips and gets hurt. Everyone gets sued.
