Combining downstream ups circuits

Good afternoon fellas,

I have an IT room in NYC with an A and B feed to a their own respective Ups, then panel. Those panels have branch circuitry that feeds twist lock devices for equipment. The conduit work for the devices is routed in such a manner that combines the circuits from A and B together. Is this a violation?

I was thinking maybe 700.10(B). But then I think everything is off the battery anyway. They are both emergency sources so it's okay.
 
With the circuitry running through one conduit, has an ampacity adjustment been calculated?

A UPS used for IT equipment is not an "emergency" system and as such nothing in Article 700 applies.

Suppose the feeders in the OP for A and B was on the load side of an ATS. Would the answer be different

Load such as UPS/IT cannot be connected to an ATS that is supplying loads that fall under Article 700. The Article 700 loads must be on their own ATS and cannot supply any load that is not classified as Article 700 load. The UPS/IT load would fall under Article 702 and would require an ATS that is not supplying Article 700 loads. In other words you can have one genset with an ATS for the Article 700 loads and another ATS for the Article 702 loads.
