I was contacted by a building manager in reference to a six story commercial building. The building manager believes that a tenant may have created a code violation.
Without including much detail: each floor has it own electrical room and panels. A tenant in the building occupies two floors. The tenant has no available spaces in the electrical panel on the fifth floor and brought a three phase circuit from the fourth floor electrical panel to an ac disconnect on the fifth floor. Are there any code violations referencing panel locations and the floors or areas they service or feed?
I think, as long all conduits, disconnects, and circuit breakers are properly labeled, this will not be an issue.

I think the major thing you have to make sure is that the allowable ampacity for the cables feeding the fourth floor panel is not exceeded with the additional load added by the subpanel on the fifth floor.
 
Although not a code violation at present, something that the building manager may want to consider is that this modification may create a violation of 240.24 (B) if tenants change and one tenant no longer occupies both floors.
