Are there any code requirements that state a
disconnect must be Nema 3R (waterproof) in a Commercial Kitchen?
If so, what section of the NEC?

Look at 110.2, 110.2 and 110.11. All equipment must be suitable for the conditions of it's use, including the conditions of water dripping or sprayed on it.
If, however, the disconnect in question is in a location where no water is likely to come into contact with it, then NEMA 1 is OK.
