Commercial service/feeder calculation Article 220 Part 2

A question came up regarding commercial calculations during a discussion with other contractors and I was hoping to get some opinions from posters here. The discussion was based upon the 2002 NEC Article 220 Part 2 (general method of calculation).

For a new restaurant (the kitchen is not air-conditioned) we have a 3 hp exhaust fan in the kitchen and 10Kw of make up air in the kitchen. Would either one of these be considered kitchen equipment subject to demand under Section 220.20?

No, 220.20 specifically says demand factors are not to apply to space-heating, ventilation, or AC equipment.

The exhaust fan will probably be a continuous load, and the 10KW heat could also run continuous in the really cold months.
