conductor ampacity and OCPD for #12

(6) #12 THHN in a conduit with an ambient that is 125F will have an ampacity of 18.24Amps. And i can protect these with 20Amps OCPD.

Now my question is: can any of these conductors be for the SABC for the kitchen?

Check 240.4(B) (going from memory)
i agree with 240.4(b)


So if after TC & conduit fill calculation my conductor ampacity for a 12AWG conductors come to 16A, i can still protect it with a 20A oCPD and still use that for the SABC.

(B) Devices Rated 800 Amperes or Less. The next higher
standard overcurrent device rating (above the ampacity of
the conductors being protected) shall be permitted to be
used, provided all of the following conditions are met:

(1) The conductors being protected are not part of a multioutlet
branch circuit supplying receptacles for cordand-
plug-connected portable loads.

(2) The ampacity of the conductors does not correspond
with the standard ampere rating of a fuse or a circuit
breaker without overload trip adjustments above its rating
(but that shall be permitted to have other trip or
rating adjustments).

(3) The next higher standard rating selected does not exceed
800 amperes.

Notice (1), you cannot round up with a branch circuit that serves multiple outlets.
