conductors of different size in same circuit

In a 4-way switch circuit is it a safety /code issue when no. 10 three wire is used with no. 12 2 wire?

Why not on a 20-ampere breaker? #10 is good for 20-ampere and so is #12?

You are always permitted to use larger capacity conductors on smaller branch circuits.

Wow. We've got a double negative situation with no double negative! :D

It is not a safety/code issue if the setup is protected by a 20 amp breaker, is what we are all trying to say. :D
