In a 4-way switch circuit is it a safety /code issue when no. 10 three wire is used with no. 12 2 wire?

Not if it's on a 20 amp breaker. 240.4.

George 240.4 will not prevent a 10 AWG on a 20 amp circuit.

Why not on a 20-ampere breaker? #10 is good for 20-ampere and so is #12?

You are always permitted to use larger capacity conductors on smaller branch circuits.

Wow. We've got a double negative situation with no double negative!

It is not a safety/code issue if the setup is protected by a 20 amp breaker, is what we are all trying to say.
