Conductors of different systems

I came across an installation of 2 each 12/2 nm cables pulled thru a 8 foot run of 3/4 inch ENT installed underslab, including a 4 pair phone cable. I issued a correction notice citing NEC art. 300.3(C)(1). The electrical contractor insists this is an okay installation, I say no. Any advice on another article?

Also if the raceway is in the earth and not the slab, then the NM is not permitted in the raceway [300.5(D)(5)]

NEC-2005 100-I states:
Location, Wet. Installations under ground or in concrete slabs or masonry in direct contact with the earth; in locations subject to saturation with water or other liquids, such as vehicle washing areas; and in unprotected locations exposed to the weather.
Learned that one just the other day... :)
