Conduit Fill rate

I am designing a system where it involves low voltage and data communication cables would reside in the same conduit. This particular conduit involves underground pvc, but stubs out as a rigid conduit. These are in concrete encased form. From my understanding, the conduit fill rate should not exceed at 40%. I was told that it can be as high as 70%. Which statement is true? An urgent response is greatly appreciated.

The limit is 40%. The reference is Table 1 within Chapter 9.

Low voltage and data cables are covered by Article 725. 725.3(A) references 300.17 for raceway fill. While that is not a very strong reference to raceway fill for this type of application, the Informational Note that follows the rule references the xxx.22 sections of all of the raceway articles.
