How does one know if these GROUNDING( Ha not grounded) conductors need to be in conduit?

GECs and bonding jumper of that size generally do not require conduit protection. What size is the service?

And what day is it measured, what has been the weather, what soil conditions are there. How would you spec this out, the only way I could see is T&M. And make sure the inspector is on site, the conditions can change big in only a week or less. What was within tolerance on day of install can be way out of specs by time inspector gets there days to weeks later.
