Is it me or what but I can't find anywhere in the code where it states you cann't have a receptacle outlet above a baseboard htr need some HELP

I dont believe you will either. There was a thread recently on this here. Someone will point you to it.
 
Only place I recall being mentioned is this FPN, but I don't think there is any code stating it is not allowed.

424.9 General. All fixed electric space-heating equipment shall be installed in an approved manner.
Permanently installed electric baseboard heaters equipped with factory-installed receptacle outlets, or outlets provided as a separate listed assembly, shall be permitted in lieu of a receptacle outlet(s) that is required by 210.50(B). Such receptacle outlets shall not be connected to the heater circuits.



FPN: Listed baseboard heaters include instructions that may not permit their installation below receptacle outlets
 
210.52 says If an outlet is made in to the permanently mounted heater, it can count as a wall space outlet..
It's 110.3(b) the UL listing which does not allow it above. It's suggested it will have a greater chance of falling in to contact with the elements if it is above it.
 
I guess the way i read 210.52(a)(2) wall space is fixed panels in exterior walls they're talking about windows with framing below the window or are you talking about another section?
 
The code does not address it. The manufacturer of the baseboard heat will determine if it can be installed under a receptacle. It will say right on the box, "Not to be installed under a receptacle" and maybe even give a distance above the heater that applies.
