Countertop receptacles

There appears to be a conflict in 210.52 (D) Bathrooms, according to a local inspector. A new phrase was added in 2011. ...", located on the countertop,"..., which seems to imply a surface mounted device. An ending sentence was added in 2011, " Receptacle oulet assemblies listed for the application shall be permitted to be installed in the countertop", which seems to imply a flush mounted device. However,the following informational note sends us to 406.5(E) which says ... "Receptacles shall not be installed in a face-up position in countertops or similar work surfaces.". This would appear to preclude any flush mounted device in a countertop, unless it was in a vertical component like a backsplash. Was this the intent of the 2011 additions?

There is no conflict. Take a look at the sentence as a whole. The word "or" appears after the phrase, "located on the countertop." We have simply been given another option, not a new requirement.
