Data Rack Above recessed panel

The plans call for a data rack to be surface mounted directly above a recessed panel. I am sure the bottom of the rack will be above 6'6'' so I am not worried about working space. My question is, does the dedicated space for a recessed panel only include the space directly above the panel (the stud bay)? Also would the data rack be considered part of the electrical installation (I don't think so)?

I don't see an issue. The dedicated space is the width and depth of the equipment.
