Delta High leg breaker

Delta Breakers, (or 3 phase to single phase high leg breakers), Its my understanding these were not allowed for new installs since the late 1970's.
I am having trouble finding the NEC 2017 code on this, making this a violation on new installs, where is it found?

I was looking at project, one that had an old style 3 phase delta breaker, and a person was called out to a repair. Apparently they were not replacing the old single phase panel and was just going to replace the delta breaker (customer didn't want to pay it), they found one from an electric shop that kept old breakers from other projects, (zinsco's, deltas etc...).

Wouldn't this still be a violation even with just the repair? Just curious.

So would this only apply to new installs, or would this apply to repairs as well?. I suppose this would be an AHJ call in some areas, whether they force a person to change out the whole panel or not.

How would you all enforce this rule given the scenario?

I would still wonder how some inspectors enforce the code in their area on existing repair situations. Would they force the install of a new panel, or let the delta breaker replacement stand.

IMO, they can not be replaced, if it were allowed there would be some rule like 406.4(D)(2)
