Demand Load above Panel Amperage

Is it possible for an electrical permit to be approved if Demand load exceeds panel amperage?
We have a project where equipment is getting replaced like for like with the exception of (2) 40A/2 circuits. If we used peak demand (83A@208v/3)+ new equipment our demand load would be well below the panel amperage(200A@208V/3). Unfortunately the equipment getting replaced isn't exact equivalent make and models so I dont feel comfortable using existing load info.

I do not like the use of terms like "demand load" since it is not something defined in the code, so it could mean just about anything.

220.87 Determining Existing Loads. The calculation of a
feeder or service load for existing installations shall be permitted
to use actual maximum demand to determine the existing
load under all of the following conditions:
...
It seems to me that once you start changing out equipment, the replaced equipment is no longer part of the "existing installation".

You might be able to get some dispensation from the local building department if you asked, but the letter of the law would seem to be against you.
