Doing a remodel to a building to convert it to a dental office. In the existing 3 rooms that will be patient care areas there is a ceiling fan in the center that will be removed. The ceilings are 8ft AFF and are sheet rock. There are also 4 can lights in each room that will remain. Every thing now is in NM. The DG switch box, by luck, are on walls that will be removed and new wall constructed about 20'' out further to enlarge the room.
Now the question. Since the cans are more than 7'6" AFF and if I turn the switch box to the out side of the room so it will not be in the room do I still have to comply with 517.13 (A) and use HCMC or can it remain in NM?
 
Raider1 has mentioned it before, you cant use the conductor for grounding.

The raceway or sheathing needs to qualify as a ground.

(Im referring to the 7'6"part)
 
Curtis, you can do away with an insulated wire EGC, see exception #2 to 517.13(B) but the raceway must still comply with 517.13(A)
