Different Panels in same MC

On a job where electrician ran 12/3 mc- red/white/green from em panel, black unswitched power from normal panel. Meets up with 12/2 sw leg to get neutral at a fixture. What can I explain to him for how terrible an idea this is? fixtures have em ballast with transfer sw built in.

Start with 300.3(B). Where is the grounded conductor from the PNL where the black originates?
