Disconnect Clearence

We have a new piece of equipment being installed under an existing disconnect. The disconnect sits about 6' up. The equipment would go under the disconnect and come out about 3' and it is only 4' tall. So the disconnect would not be blocked. In otherwords, I would have to lean over this 3' wide piece of equipment to shut off the disconnect. Is this legal for the NEC?

From reading your post, it appears the equipment you want to mount underneath the existing disconnect may indeed infringe upon the working space of the disconnect. If you take a look at 110.26, you'll get some very clear language regarding working space. Essentially working space is that area affording protection to the worker while maintaining the equipment. Of course, it's ultimately the call of your your AHJ, but if the working space is obstructed to such a manner as to affect the safe maintenance of the existing equipment, then you should probably reconsider the placement of the new equipment.
