disconnect for hot water heater

got a discusion going where one inspector believes a disconnect is reguired to be "in sight " of a permanently hard wired hot water heater (240 volt). i say no because it's not over 300 volts. based on 422.11 and 422.31, 2008 NEC, any takers ?:bye:

I don't understand where the 300V or 422.11 comes into play here. If the disconnecting means meets the "lockable" requirements of 422.31(B), your golden.

Here in Va. we don't heat HOT water, we heat cold water!!!!!:angel::lol:
