Disconnect install "ON" an HVAC System

I was told I couldn't mount a service disconnect on an HVAC air handler (5 Ton Units). The air handers is located in a mechanical room in the atic with the Disconnect on top of the system. Not on the system access door. According to 440.14 it states "The disconnecting means shall be permitted to be installed on or within the air-conditioning or refrigeration system". Just wondering if I understood this wrong or missed something.
 
IMO as long as you comply with the second paragraph of 440.14 you're fine.

440.14 Location.
Disconnecting means shall be located within sight from and readily accessible from the air-conditioning or refrigerating equipment. The disconnecting means shall be permitted to be installed on or within the air-conditioning or refrigerating equipment.
The disconnecting means shall not be located on panels that are designed to allow access to the air-conditioning or refrigeration equipment or to obscure the equipment nameplate(s).
 
yes the disconnects where located on the top, with the access panel on the side. The code inspector had me move all of them on the stud.

Well in that case, unless there's a specific local code amendment the inspector was incorrect. You should ask for a code reference for the violation.
 
Not an electrical violation but the Mechanical code 309 to be exact says it shall be installed adjacent to and in sight of the equipment.

I was always afraid to try to mount the disconnect on the equip. because most all the panels on equipt. can be removed to gain access to other places besides the main service panel. And the code doesnt specify they are talking about the main service panel. I wouldnt want it mounted on my own equip in case I had to take the top or side off for some reason.

somewhere in Texas - maybe Austin - the local code disallows disconnects mounted on the units
