Disconnecting Means

In an installation that has stackable air-conditioning units that are set on a concrete pad and each unit having it's disconnecting means attached to the unit, if the disconnecting means for the upper unit is mounted with the handle height of the disconnect at approximately 7'6" would this violate the requirement of 440.14 or would exception #2 to article 404.8 be applicable in this instance? All opinions appreciated.

It looks like it would be OK to me. IMO, the reason for the disconnect is the safety of the service technician. We also call these the service switch. If a technician is working on an elevated item of equipment he will have a ladder anyway and may disconnect the power as needed.
