Disconnects on Roof Top commercial units.

This subject has been beat to death but I need to ask again. Roof top AC units that have their own disconnect switch. This meets 440.14 but I am being told there is a mechanical code that prohibits this. Doesn't HACR rated breakers and LOTO cover means of external disconnect and the switch cover maintenance disconnect?

This is compliant as a disconnecting means according to the NEC. I've heard of many "codes" over the years that don't really exist.
 
A factory disconnect may be installed however the manufacturer wants to.

Of Course not. I was in a city once, remember where, that required a disconnect mounted on a separate structure, like a rack or wall, just incase the customer decides to replace the entire air handler. I showed the inspector 440.14 and he said he doesn't care. I argued that if the entire unit is going to be replaced than much more is going to be done than just disconnecting the wires, and the company doing it will know what to do. He didn't care, so on a rack the disco went.
