disposal switch at backsplash wet area

I have seen several diferrent methods used when installing the disposal switch. Usually the switch is installed at least 24" away from the edge of the sink. Recently, I have seen them installed directly above the sink. My problem with this condition is that the switch plate is not water tight and the likeliness of water accessing the interior of the switch is high. Please advise.
 
I don't think it's a good location, but I can't think of a code article that forbids it. The switch needs to be close enough for a person to reach it and to reach the faucet at the same time. But even that is a design feature, not a code requirement.

are you thinking someone is going to use the sprayer on the switch?

i am not sure even that would create any special hazard. the live parts are inside the switch box. nothing exposed.

how many times in the life of a switchplate in a kitchen is someone going to wipe it with a damp cloth?

A switch - yes ~ because it doesn't say you can't :rolleyes:.... a recept - no 406.4(E)
