distribution panel capacity

I noticed a 30 circuit panel with 43 circuits including the main disconnect. I know that the panel can only have a maximum of 42 circuits(including main) but doesn't the panel have to be a 40 circuit panel? A number of circuits were replaced with mini breakers.

The main doesn?t count. You would need to look at the label to see if twin breakers are permitted any of the positions. Frequently 30 circuit panels are marked 30-40 and designed to accept 10 twin breakers.

408.35 Number of Overcurrent Devices on One Panelboard
Not more than 42 overcurrent devices (other than those provided for in the mains) of a lighting and appliance branch-circuit panelboard shall be installed in any one cabinet or cutout box.

Curt is correct. I would add that if the panel doesn't fall under the definition of a Lighting and Appliance Branch-circuit Panelboard than it would be a Power Panelboard and would not have a 42 circuit limitation.
