I'm getting conflicting information about DLO RHH/RHW-2 cable. Our license holder is stating that DLO-RHH/RHW-2 cable falls under art 400 and thus cannot be installed in conduit. My stance is that this cable is RHH/RHW and thus falls under 310 with all the rest. We're planning on using this cable to feed a distribution board and want to take advantage of its flexibility.

The correct compression lugs with have two wire sizes. The second one will be preceded by the word FLEX and that's the one for DLO.

Not always...you can buy compression lugs that are only rated for use with DLO, and sized for the non-standard sizes, such as 262.6 kcmil or 535.2kcmil, that they make DLO in.

You won't find DLO in Article 400. For the purposes of the NEC that cable is RHH/RHW and all of the rules for those cable types apply.
Note if you do install the DLO in conduit, make sure that 100% of the conductor surfaces are covered with wire pulling lube....it gets much more difficult to pull if there are any "dry spots".
